OLDSTYL – TERMS & CONDITIONS

I. GENERAL PROVISIONS

  1. Online store oldstyl.eu is operated by Anna Sekuła, trading as Anna Sekuła Przedsiębiorstwo Handlowo-Usługowo-Produkcyjne "SEART" with headquarters in Kotlice 103, 26-020 Chmielnik, VAT Number (NIP): 6572432962, REGON number: 292453318, registered in the Central Registration and Information of Business (CEIDG). The store will be called „Oldstyl”
  2. In accordance to Terms & Conditions, Terms & Conditions of Electronic Services, and Privacy Policy:
    1. User is understood as a natural person (over 13 years old; please note that persons under 18 consent of his/her statutory representative are required), a private party, a legal person, a business unit that is not a legal person, granted the legal capacity by law, placing an order or using the online store Oldstyl in any other way.
    2. Consumer is understood through Article 22(1) of the Statute dated 23rd April 1964 – Civil Code (Journal of Laws of 1964, No. 16, item 93). Provisions related to Consumers apply also to natural persons concluding a contract directly related to their business activity, when the content of this contract shows that it does not have a professional nature for them (mainly distant from their business activity), as provided on the basis of provisions on the Central Registration and Information of Business – to the extent specified in the Act dated 31st July 2019 on changes in some acts to limit regulatory burden (Journal of Laws of 2019.1495, dated 8th August 2019).
    3. Store is understood as an online store available oldstyl.eu and operated by Anna Sekuła.
    4. Order is a declaration of the User’s will, directed to the conclusion of Sale Contract or Contract for Specific Task via the online store or phone.
    5. Sale Contract is a distant sale contract between Oldstyl and User, under the conditions specified in Terms & Conditions.
    6. Contract for Specific Task is a distant contract for a specific task between Oldstyl and User, under the conditions specified in Terms & Conditions. Oldstyl commits itself to produce the goods ordered by the User.
    7. Business Day is a weekday (Monday – Friday) that is not a public holiday, as understood in the Act of 18th January 1951 on public holidays (Journal of Laws of 1951, No. 4, item 28)
    8. Contact details are understood as:
      1. - for Natural Persons: name, surname, residential address, e-mail address, phone number. If the service ordered relates to the performed business activity, then contact details also include company and VAT number (NIP).
      2. - for Legal Persons and Business Units that are not Legal Persons but are granted the legal capacity by law: company name and address, mailing address, VAT number (NIP), e-mail address.
  3. To place an order, the User should read and accept Terms & Conditions.
  4. Orders can be placed 24 hours a day, 7 days a week, all year round. Store reserves the right to impose restrictions in using its services, resulting from technical, legal or economic reasons. Restrictions will be imposed with prior notice.
  5. Information presented on the Store’s website to Users that are not Consumers is only an invitation to conclude a contract (in accordance with Article 71, Civil Code).
  6. All goods purchased in Oldstyl are new and covered by the warranty of the manufacturer that lasts for 2 years from a day of a Sale Contract conclusion.

  9. Store Oldstyl is obligated to deliver all goods without legal or physical defects.

II. ORDER PLACING AND COMPLETION

  1. Orders are accepted via Oldstyl.eu website, through „CART”. While placing an order, User indicates the products to be ordered, provides contact details and choosed delivery and payment method. Sale Contract is concluded in Polish. In exceptional cases, orders may be placed via phone: +48 661 155 639.
  2. Once the Order is placed, User receives an e-mail confirming that the Store recived the Order. This information does not mean that the Order was processed and moved to realization or that Sale Contract or Contract for Specific Task was concluded.
  3. Oldstyl presents an offer to User within 7 days of the above mentioned information. The Offer will be related to either a Sale Contract or a Contract to Specific Task, depending on the goods ordered (if the goods are already produced ot will be produced). The Offer will also provide time of realisation and shipping and handling costs.
  4. If Offer is not presented within the time stated, Store refuses to realise the Order. Oldstyl is bound by the Offer for 7 days of the day of sending the Offer or presenting it via phone to User. Oldstyl has the right to refuse to provide Offer to User, especially when there is a reasonable doubt about reliability or it is supported by serious economic reasons.
  5. Offer of Oldstyl is accepted the moment that User confirms Order. Then Sale Contract or Contract to Specific Task is concluded.
  6. Order Completion begins:
    1. for Orders paid in the form of prepayment via bank transfer – once the payment is registered on the Store’s bank account
    2. for Orders paid in the form of prepayment via credit/debit card – once the card is authorised
    3. for Orders purchased on the installment plan – once the credit is approved
    4. for Orders paid on delivery – within 14 days of Order being confirmed by User who is Consumer (once Offer is accepted) or within 14 days of registered on Store’s bank account advance payment from User who is not Consumer.
  7. Sale Contract is concluded between Oldstyl and User when the goods ordered are available off the shelf.
  8. The website provides approximate completion time of Sale Contracts and Contracts of Specific Task. This is the time that should be sufficient for Oldstyl to produce the goods and prepare them for delivery. The actual time of completion is presented to Users in Quotes. Oldstyl is obliged to inform Users if the time might be extended, agree on a new completion time, introduce changes to Order or cancel Order (termination of Sale Contract / Contract of Specific Task made by mutual agreement, according to which both Parties commit themselves to return everything that was involved during the Order completion).
  9. Completion time of the concluded Contracts caanot be longer than 30 days, starting off the date that Order was placed, unless both Parties agreed on different term.
  10. Storing, securing and sharing Orders data is performer via e-mail. Earlier Orders can be seen on User’s account, after logging in.

III. SHIPPING & HANDLING

  1. Pricing is presented on the website in Polish Zlotys (PLN) and other currencies, VAT included (Value-added tax). Prices do not include Shipping and Handling, which costs are added to each product separately or are calculated individually.
  2. Cost of Shipping and Handling vary, subject to payment method, delivery type and place. The Cost is presented on the Quote.
  3. To accept Shipping and Handling costs, User should confirm the order (accept Quote) within 7 days of the day that Quote was sent tor presented via phone. If the order is not confirmed by User, Sale Contract or Contract of Specific Task is not concluded.
  4. Customer does not cover the costs of Shipping and Handling when Order value exceeds 1000 PLN and delivery address is located in Poland.
  5. Oldstyl restricts the right to modify the pricing of the goods on offer. It does not apply to already concluded Sale Contracts, Contracts of Specific Task or Orders placed by Consumers.
  6. Oldstyl restricts the right to withdraw some of the products presented on the website from the offer. It does not apply to already concluded Sale Contracts, Contracts of Specific Task or Orders placed by Consumers.
  7. Oldstyl is not responsible for late deliveries caused by Couriers in the case of Users who are not Consumers.
  8. Couriers are not obliged to bring the packages into houses if the parcel’s weight exceeds 30 kg. In this situation, User is obliged to collect the parcel from Courier’s vehicle.
  9. Deliveries take place on Business Days, time as established by Couriers. OldStyl cannot provide ETA or agree on any specific time of delivery. 
  10. If User ordered goods from different manufacturers, Oldstyl will deliver each product separately, unless agreed otherwise. If such Order is supposed to be delivered as one parcel, then the delivery time is subjected to the term of the last item of the Order is available. This rule does not cancel or restrict point 15.
  11. Once the goods are delivered, Used (Customer) is obliged to check the goods. Complaints of Users (not Consumers) for mechanical defects caused during transport will only be investigated if Damage Report was written and signed by both addressee and courier. Complaints about goods damaged in transport without written Damage Report will not be investigated.
  12. All the entries in section III that relate to consumer sales, apply also to Natural Person concluding a contract directly related to his/her business activity when the content of this contract shows that it does not have a professional nature for him/her (mainly distant from his/her business activity), as provided on the basis of provisions on the Central Registration and Information of Business.

IV. PAYMENT

  1. Oldstyl offers the following payment methods:
    1. on delivery,
    2. via bank transfer as prepayment,
    3. PayU,
    4. hire-purchase - PayU,
    5. PayPal,
    6. by debit card as prepayment (operated by PayPro SA Agent Rozliczeniowy; address: Ul. Kancelarska 15, 60-327 Poznań; registered on the Enterpreneurs Register of the National Court Register operated by Poznań District Court Nowe Miasto and Wilda in Poznań, Commerce Department of the National Court Register VIII, NCR number 0000347935, NIP (VAT Number) 7792369887, REGON 301345068,
    7. hire-purchase - Santander,
    8. in the company’s premises.
  2. Available payment methods are listed on the website with each product on offer. Consumers are not obliged to make prepayments or advance payments if the chosen method is payment on delivery.
  3. A fiscal receipt or VAT Invoice is issued to every Order. Acceptance of the Terms & Conditions is equal to permission to issue the VAT Invoice via e-mail and post (generated automatically by Accounting System of Store).
  4. E-Invoice is generated and sent by the system once the parcel is collected by a courier.
  5. Lack of consent for receiving e-invoices should be reported, along with the wish to receive a paper version of accounting documents (VAT Invoice or fiscal receipt). In this case, Store will post the requested document within 14 days, addressing it in accordance with the details provided by the User.

V. COMPLAINTS

  1. To submit a complaint, Oldstyl should be contacted via e-mail. User should provide a full name or company name in whose name the order was placed, order number, and description of the defect. The expected action should also be indicated. Complaints are processed within 14 days of submission.
  2. Slight differences in coloring cannot be the reason for complaints about Users that are not Consumers. Colours of accessories presented on the website, especially made of metal, wood, or fabrics are indicative only and may differ from reality.
  3. Despite doing our utmost, we cannot guarantee Users who are not Consumers that technical specifications, product descriptions, and pricing do not include errors or mistakes. However, these cannot be treated as a basis for complaint. Should you have any doubts, please do not hesitate to contact us before you decide to place an order.
  4. All the entries in section V that relate to consumer sales, apply also to Natural Person concluding a contract directly related to his/her business activity, when the content of this contract shows that it does not have a professional nature for him/her (mainly distant from his/her business activity), as provided on the basis of provisions on the Central Registration and Information of Business.

VI. RIGHT OF WITHDRAWAL

  1. Users who are Consumers have the right to withdrawal from concluding the distant contract within 14 days of delivery, for any reason and without a justification. Return Form should be completed or Statement of Withdrawal written (full name, address, order number, bank details) and sent. Proof of purchase should be provided when possible. Consumer should post the Form or Statement to the following address: RustykalneUchwyty.pl, Kotlice 103, 26-020 Chmielnik. It can also be sent via e-mail: reklamacje@rustykalneuchwyty.pl. Template of the Statement of Withdrawal is available at: www.oldstyl.eu.
  2. If Statement of Withdrawal was submitted via e-mail, Oldstyl.eu responds immidiately, confirming receipt of the document.
  3. When Consumer exercises the right of withdrawal, he/she is obliged to return the goods immidiately – within 14 days of the Return Form submission.
  4. Consumers are liable for any diminished value, if it is caused by his/her actions that exceeded a standard check up of charcter, features and function of the purchased goods. Thus, we recommend returning the goods in the quantity and quality equal to the ones at the time of delivery. Highly recommended is enclosing all the received parts, accessories, manuals, etc. (apart from the proof of purchase). If possible, please send the goods back in the original package along with receipt or signed credit note. However, lack of the original package or any of the mentioned documents, or changes in the product will not affect the right to withdrawn from the contract.
  5. Returns, along with the Statement of Withdrawal, should be posted to the following address: RustykalneUchwyty.pl, Kotlice103, 26-020 Chmielnik, POLAND. Please mark the package as „RETURNS”. Costs of return are covered by Users. Oldstyl does not accept packages sent as „cash on delivery”. Oldstyl returns funds to Consumer within 14 days via bank transfer, in accordance to the bank details provided by User. Oldstyl reserves the right to withhold return of the goods to the time of receipt of the goods or of the proof of the package sending (whichever is registered sooner). Direct costs of the returned are payable by User.
  6. Unless agreed otherwise, Consumers have not got the right to wihdrawn from the contract in the following situations:
    1. if the purchased goods are not prefabricated, but customized in accordance to the Consumer’s guidelines or to fulfill Consumer’s personalized needs,
    2. when Consumer clearly requested the entepreneur to personally repair or carry out maintenance task: if the entepreneur additionaly offers services different from those requested by the Consumer, or delivers different replacements from those needed to repair or carry out maintenance task, then the Consumer’s right to withdrawn from the contract relates to the additional services or items.

All the entries in section VI that relate to the right of withdrawal from the contract apply also to Natural Person concluding a contract directly related to his/her business activity, when the content of this contract shows that it does not have a professional nature for him/her (mainly distant from his/her business activity), as provided on the basis of provisions on the Central Registration and Information of Business.

VII. FINAL PROVISIONS

  1. User’s data is protected under the Data Protection Policies of Oldstyl.eu
  2. Opening, managing and deleting User’s account is regulated by the Regulations Governing the Provision of Services by Electronic Means of Communication. 
  3. Disputes related to the contract between the Store and User and not the Consumer are subjected to the court proper as to the registered office of Oldstyl.eu. Users are also entitled to out-of-court ways to complaint handling (mediation, arbitration court) and redress. Notwithstanding the foregoing, User who is a Consumer can engage Regional (Municipal) Consumer Ombudsmen. All relevant information can be found at the Personal Data Protection Office website: https://uodo.gov.pl/en.
  4. All the entries in point 3 (above) apply also to Natural Person concluding a contract directly related to his/her business activity, when the content of this contract shows that it does not have a professional nature for him/her (mainly distant from his/her business activity), as provided on the basis of provisions on the Central Registration and Information of Business.
  5. Changes introduced to Terms & Conditions apply only to these Users, whose orders are placed after these changes have entered into force. The changes enter into force 7 days after their announcement on the website (Oldstyl.eu). For those Users who had placed an order before the changes entered into force, unchanged Terms & Conditions apply. However, they can request for the new Terms & Conditions to apply to their order, and thus the Sale Contract or Contract for Specific Task should be changed accordingly (after approval of both parties).
  6. To the extent not provided for under this Terms & Conditions, provisions of Polish law and EU apply – especially from the Act of 23rd April 1964 Civil Code (consolidated text: Journal of Laws of 2018, No. 398, item 650), Act of 24th June 2014 on Consumer Rights (2018, item 650), Regulations of the European Parliament and of the Council (2016/679 dated 27th April 2016, on the protection of individuals concerning the processing of personal data and the free movement of such data, and repel the Directive 95/46/WE (EU Official Journal L 119, p. 1), Act dated 18th July 2002 on the provision of services by electronic means (consolidated text: 2018, item 650). 
  7. Under Regulations of the European Parliament and the Council (EU) No. 524/2013 dated 21st May 2013, Online Dispute Resolution (Consumers vs Entrepreneurs, Union-level) is available at: //ec.europa.eu/consumers/odr. The ODR Platform is a website offering a complex service for consumers and entrepreneurs intending to resolve disputes related to contractual commitments resulting from online Sale Contract or Contract for Specified Task out-of-court.
